2. Scope of Application, Conclusion of Contract, Protection of Minors
These General Terms and Conditions (GTC) apply to all legal relationships between Schenk Suisse SA and those who order products or services from Schenk Suisse SA (customer), regardless of the ordering method. Any deviation from these General Terms and Conditions is only valid if it results from an individual agreement confirmed in writing. The current version of these GTC is published by Schenk Suisse SA on its website and in the sales documents.
By placing an order, the customer expressly declares their acceptance of these General Terms and Conditions. The contract between Schenk Suisse SA and the customer is concluded from the moment Schenk Suisse SA sends its order confirmation to the customer (in writing, by telephone, email, or by any other means). The quantities, prices, and delivery times confirmed by Schenk Suisse SA are final.
The law prohibits the sale of wine, beer, and cider to persons under 16 years of age and the sale of spirits, aperitifs, and alcopops to persons under 18 years of age. By placing an order, the customer confirms that they are at least 18 years of age.
3. Prices
Prices are in accordance with the current price list and the prices published on the Schenk Suisse SA website at the time the order is received. Prices are in CHF, per unit, excluding VAT, deposit, and shipping costs. VAT is shown separately on the invoice. Schenk Suisse SA reserves the right to change its prices at any time.
4. Products and Vintage Changes/Offers
Offers are valid while stocks last. Schenk Suisse SA is not obligated to supply specific products or vintages (except for vintage Bordeaux).
Schenk Suisse SA reserves the right to replace, without notice, a vintage that has been sold out with a subsequent vintage of the same quality.
5. Order Receipt/Preparation Deadline
Goods ordered by 10:00 a.m. will be delivered on request the next business day. A requested delivery date is only considered final after our confirmation. Schenk Suisse SA is entitled to make partial deliveries; the customer is informed of this in the order confirmation.
6. Minimum order delivered
For deliveries below a value of CHF 1,500 (excluding VAT and packaging), a transport contribution of CHF 75 will be charged in addition.
7. Minimum order collected from our carrier
Customers who collect the goods themselves benefit from our collection discounts (see point 8). From now on, collections will be made from our carrier, Planzer Transports SA, Bâtiment D, ch. de l'Islettaz 7, 1035 Penthalaz.

9. Pallet Discount
The pallet discount is only valid on items and prices at the regular price.
10. Deliveries and Collections / Assumption of Risk
In the event of delivery or collection, the risks and benefits pass to the customer upon receipt of the goods.
The customer is responsible for ensuring that Schenk Suisse SA is able to make the delivery.
The customer is responsible for any damage due to problems occurring during delivery that are not the responsibility of Schenk Suisse SA (e.g., no access to the building, customer absence, incorrect address).
11. Inspection and Complaints / Returns
11a. Complaints
All complaints must be made within three business days of receipt of the goods. In the event of irregularities or abnormal waste noted upon arrival, the buyer is required to have a report drawn up by the carrier.
11b. Returns of Delivered Wines
We are unable to accept returns of goods without prior notice and our agreement. Wine replacement / goods replacement: following the decision of the Swiss Wine Trade Association and in accordance with Art. 197 et seq. of the Code of Obligations:
If the problem is justified, Swiss and foreign wines bottled in Switzerland will be replaced or refunded within one year from the delivery date.
Foreign wines bottled in the country of production will not be refunded.
11c. Exclusion of Warranty for Damages Due to Defects
Under no circumstances may the customer claim compensation for defects not arising from the goods themselves, such as loss of production, business interruption, loss of profits, or other direct or indirect damages.
12. Warranty and Liability
All our wines are guaranteed and comply with the legal requirements in effect at the time of sale.
Schenk Suisse SA only guarantees the product properties expressly guaranteed in the corresponding sales documents; all other warranties are excluded. Subject to the exceptions provided for in these General Terms and Conditions or in individual agreements.
13. Payment Terms
Under glass: 1% at 10 days, 60 days net (from the invoice date).
Loose: 30 days net (from the invoice date).
For advance payments: 10 days net, otherwise the order will be canceled. In special cases, the payment terms indicated on the invoice may differ from the general terms and conditions stipulated above. In such cases, the terms and conditions on the invoice shall prevail.
14. New Customers
For all new customers, Schenk Suisse SA will conduct a prior credit check and reserves the right to apply specific payment terms for initial orders.
15. Framework Agreements
For framework agreements, delivery must take place by the date specified in the contract, failing which, no later than one year from the date of the framework agreement. After this year, Schenk Suisse SA specifically reserves the right to increase prices and storage costs if prices other than the current prices have been agreed upon. Schenk Suisse SA is free to deliver the entire order at once, provided no other agreement exists. In the event of payment difficulties on the part of the customer, Schenk Suisse SA is free to waive remaining deliveries or to require a payment guarantee upon collection of the remaining quantities.
In the event of a company takeover or merger, confirmed contracts are transferred to the legal successor.
16. Data Protection
Schenk Suisse SA processes personal data in accordance with applicable legislation. You can find further information on the processing of personal data and data protection on the dedicated page at the bottom of the page.
17. Photos and Labels
The product photos included on our website are not contractually binding. Schenk Suisse SA reserves the right to change their design without prior notice.
All our labels are registered trademarks. They may only be used for the sale of the products delivered by us.
18. For
The contract established between the customer and Schenk Suisse SA is based, in all cases and exclusively, on Swiss law, which alone is applicable.
For all disputes, the exclusive jurisdiction of the ordinary court located at the registered office of Schenk Suisse SA in CH-1180 Rolle shall be vested.
19. Amendments and Supplements
Schenk Suisse SA expressly reserves the right to adapt these General Terms and Conditions at any time to suit the circumstances and to apply them immediately.
